Terms of Use

These Terms of Use (“Terms”) govern access to and use of www.caccc-usa.org and any CACCC webpage that links to these Terms (collectively, the “Site”). The Site is operated by Chinese American Coalition for Compassionate Care (“CACCC,” “we,” “our,” or “us”), a California-based 501(c)(3) nonprofit organization.

By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

If you are under 18, you may use the Site only with the involvement and permission of a parent or legal guardian where required by law. The Site is not directed to children under 13.

You may use the Site for lawful, personal, educational, and noncommercial purposes consistent with CACCC’s mission. You agree not to:

• Violate applicable law or the rights of another person or organization.
• Interfere with the Site’s operation, security, integrity, or availability.
• Attempt to gain unauthorized access to systems, accounts, data, or networks.
• Use automated scraping, data-mining tools, robots, or similar methods without CACCC’s prior written permission.
• Upload or transmit malicious code, harmful content, or material that is unlawful, infringing, abusive, or deceptive.
• Misrepresent your identity or affiliation with CACCC.
• Use the Site in a way that could harm CACCC, its community, its mission, or another person.

Educational Content. Not Medical or Legal Advice

CACCC provides educational materials, webinars, videos, discussions, and links concerning advance care planning, caregiving, serious illness, end-of-life issues, and related topics. This information is for general educational purposes only. It is not medical, legal, financial, tax, mental-health, or other professional advice, and it is not a substitute for advice, diagnosis, or treatment from a qualified professional who understands your circumstances.

Use of the Site does not create a doctor-patient, attorney-client, therapist-client, fiduciary, or other professional relationship with CACCC, its officers, directors, employees, volunteers, presenters, or content contributors. Do not disregard or delay professional advice because of information found on the Site. For a medical emergency, call 911 or your local emergency service.

CACCC makes reasonable efforts to provide useful information but does not warrant that educational content is complete, current, error-free, or suitable for a particular person or situation. Views expressed by guest speakers, presenters, authors, or linked organizations are their own and do not necessarily represent CACCC.

Intellectual Property

The Site and its content, including text, graphics, logos, photographs, videos, educational materials, compilations, and trademarks, are owned by or licensed to CACCC and are protected by applicable intellectual property laws.

You may link to publicly available CACCC content and may share brief excerpts for noncommercial educational purposes with clear attribution to CACCC, unless the content states otherwise. You may not reproduce, modify, distribute, sell, license, publicly display, or commercially exploit substantial Site content without CACCC’s prior written permission or another legal right to do so. Third-party materials remain subject to the rights and terms of their owners.

Private communications, registrations, applications, and personal information you submit are handled as described in the Privacy Policy and are not treated as public content merely because you submitted them through the Site.

CACCC asks participants to sign a release before CACCC uses their feedback, testimonials, or quotations publicly. Any such public use is governed by the signed release.

If you intentionally submit material for public posting, publication, or sharing by CACCC, you grant CACCC a nonexclusive, worldwide, royalty-free license to use, reproduce, adapt, display, and distribute that material for CACCC’s charitable, educational, and promotional purposes. You represent that you have the rights and permissions needed for the submission and that its use will not violate law or another person’s rights. CACCC is not required to publish or retain a submission.

Donations

Online donations are administered through GiveWP and processed by PayPal. Donors may pay using PayPal, Venmo, or debit or credit card options powered by PayPal. Donors may use CACCC’s donor dashboard to view donation history and access receipts. CACCC may provide an electronic or written acknowledgment or receipt in accordance with applicable law and its recordkeeping practices. A donation may be tax-deductible only to the extent allowed by law. CACCC does not provide tax advice, and donors should consult their own tax adviser.

Unless applicable law requires otherwise, donations are generally final and nonrefundable. If you believe a donation was made in error or without authorization, contact info@caccc-usa.org promptly. CACCC will review refund requests individually, subject to applicable law, the circumstances, and PayPal’s policies. If recurring donations are offered, you may be able to manage or cancel future charges through the GiveWP donor dashboard or PayPal, or by contacting CACCC. Cancellation does not automatically refund a charge already processed.

Purchases and Payments

Any merchandise or other purchase offered through the Site is subject to the price, availability, payment, shipping, return, and other terms disclosed at checkout or in a separate policy. CACCC may correct errors, limit quantities, or cancel an order when reasonably necessary, including when an item is unavailable, a price is incorrect, or fraud is suspected. Donations are governed by the Donations section above and are not purchases of goods or services unless expressly stated.

Third-Party Links and Services

The Site may contain links to or embed content and services operated by third parties. CACCC does not control and is not responsible for third-party content, availability, privacy, security, or terms. A link does not necessarily mean CACCC endorses the third party or all of its views, products, or services.

Disclaimer of Warranties

To the maximum extent permitted by law, the Site and its content are provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose, title, and noninfringement. CACCC does not warrant that the Site will be uninterrupted, secure, or error-free.

Limitation of Liability

To the maximum extent permitted by law, CACCC and its directors, officers, employees, volunteers, agents, presenters, and content contributors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, revenue, or profits, arising out of or related to the Site or its content, even if advised that such damages were possible. Nothing in these Terms excludes liability that cannot lawfully be excluded or limited.

Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless CACCC and its directors, officers, employees, volunteers, and agents from claims, liabilities, damages, losses, and reasonable costs arising from your unlawful use of the Site, your material violation of these Terms, or content you submit for public use. This provision does not apply to the extent a claim results from CACCC’s own unlawful conduct.

Suspension or Termination

CACCC may restrict, suspend, or terminate access to all or part of the Site when reasonably necessary to address a violation of these Terms, protect the Site or its users, comply with law, or protect CACCC’s mission and operations. Provisions that by their nature should survive termination will remain in effect.

Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. To the extent permitted by applicable law, any dispute arising out of or relating to the Site or these Terms shall be brought exclusively in the state courts located in Santa Clara County, California, or, when federal subject-matter jurisdiction exists, in the United States District Court for the Northern District of California. Each party consents to the personal jurisdiction and venue of those courts. This provision does not waive any right or remedy that applicable law does not permit a party to waive.

Severability and No Waiver

If a court finds any provision of these Terms unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will remain in effect. CACCC’s failure to enforce a provision is not a waiver of its right to do so later.

Changes to These Terms

CACCC may update these Terms from time to time. The revised Terms will be posted on the Site with an updated date. Continued use of the Site after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.
